thanks for adding the link to http://www.gahetna.nl/over-ons/open-data but I fear this is not enough: please note that they write Een groot deel van dit materiaal is beschikbaar als open data met een open licentie of verklaring. – "Een groot deel" meaning "a large part". This means that some, but not all pictures are in the public domain or licensed under a creative commons license. If a file is "free", this is noted in the meta data, an example can be seen here – note the green circle to the right of the example picture shown there. the image in question is missing any evidence of a CC-BY-SA liocense or a public domain mark, so as far as we know it is still copyrighted. So unfortunately, I'll have to re-nominate this file for deletion (but I'll make it a "regular" deletion request instead of a "speedy" one to give some other peope the opportunity to share their thoughts about this). --El Grafo (talk) 15:23, 30 June 2014 (UTC)Reply[reply]

File deleting

@Oltnilhnn: Find out who holds the copyright of this image - probably the photographer. If he (or she) agrees to release the image under a free license, he must send an email with a permission to our support team. ich hatte das wegen [67] für eine Urheberrechtsverletzung gehalten. File:Konstanze Krueger1.JPG hatte ich leider nicht bemerkt, genauso wenig wie die vorhergegangene Löschdiskussion. Das ist ärgerlich, wo ich doch eigentlich immer auf Sorgfalt bedacht bin, aber bei der riesigen Anzahl an echten Urheberrechtsverletzungen, mit denen wir hier zu kämpfen haben, bleibt es wohl nicht aus, dass man manchmal daneben greift. Ich werde natürlich die Wiederherstellung der Datei beantragen, melde mich dann wieder. You asked about {{Anonymous-EU}} with regard to Spain. The relevant portion of the law is this:

Los derechos de explotación de las obras creadas por autores fallecidos antes del 7 de diciembre de 1987 tendrán la duración prevista en la Ley de 10 de enero de 1879 sobre Propiedad Intelectual.
Shortened translation: The rights to works by authors deceased before 1987 will have the duration in the 1879 law.

This rule does not seem to make any difference between authors who are anonymous and authors who are not anonymous, so it seems that the term in the 1879 law also applies to anonymous authors who died before 1987. In the 1879 law, I only find one term, life+80 years, so I would assume that this term applies to all works, even if the author is anonymous.

I think that it is a bit problematic to use a term based on the death year of the author if the author is anonymous as the only ones who might know the identity normally are the heirs of the author. These can then sue someone for using the work and present whatever evidence of authorship they have in court. There is a similar problem in Germany, where some anonymous artworks are protected for a term of 70 years from the death of the anonymous author. See de:Anonymes Werk (Urheberrecht)#Frühere Rechtslage in Deutschland/Übergangsrecht. Thanks very much for your concern, the image uploaded is my own artistic rendition realized at "low resolution" and recolored applying yellow, cream and Khaki beige filters, it is indeed based on a previous older image that was already available in the public domain as {{PD-Italy}}. Please dont delete it.

Hello there, I've uploaded two SVG files which I edited based upon w:Dogecoin official logo, Dogecoin is a cryptcurrency open-source project released under MIT license[151], its cofounder ummjackson released the original files under Creative Commons Attribution license[152][153], however a user nominated them claiming copyright violation. Hi El Grafo,

I saw the post COM:VP#Angel's Logo.png flagged for deletion by El Grafo and it appears that Demetrius Guidry had re-uploaded File:Angel's Logo.png as File:Angel-sessions-logo.png. Even though Guidry is claiming to be the copyright holder, I am not sure if he should have tried to do without following the steps you laid out in your reply to his post. Any suggestion on what should be done in this case? For what it's worth, he seems to want to use the file in en:Draft:Angel Sessions which he has submitted to be added to Wikipedia. The draft has already been declined once and, based upon his post at the Village Pump, it appears that he has an obvious conflict of interest and is trying to create an article about his wife. This means there is a good chance that the draft will be declined again. I am not sure if any of that has a bearing on whether the photo should be allowed to be uploaded to Commons, but it might indicate that he is not too familiar with the policies of either Wikipedia or Commons. - Marchjuly (talk) 11:59, 25 September 2014 (UTC)Reply[reply]

Hi Marchjuly, thanks for the update. The file has already been deleted by User:INeverCry. It's quite possible that Demetrius Guidry didn't notice my answer at the Village Pump, so I've left him another message at his Wikipedia talk page (mainly to avoid accusations à la "you deleted my file and didn't even notice me"). As long as he doesn't provide a permission via OTRS, his files will be deleted. If he does provide a permission but his draft gets declined, one could think about whether the files are still within COM:SCOPE. --El Grafo (talk) 18:14, 25 September 2014 (UTC)Reply[reply]
